General Terms and Conditions

1. Scope
These General Terms and Conditions (GTC) govern the use of the Alphorn notification routing platform ("Service") operated by Armin Reiter, sole proprietor, Vienna, Austria ("Provider"; full contact details in the Imprint). By creating an account or using the Service, you ("User") agree to these terms.
2. Service Description
Alphorn is a notification routing platform that receives webhooks and delivers messages to user-configured channels (e.g. Slack, Discord, Email, SMS). The Service is available as a hosted version at app.alphorn.dev and as a self-hosted open-source application.
These GTC apply to the hosted version only. Self-hosted installations are governed by the software license (AGPL-3.0-or-later, or the commercial license where applicable).
3. Account Registration
To use the hosted Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account.
4. Plans and Pricing
The Service is available in free and paid plans as described on our pricing page. Paid plans are billed monthly. Prices exclude applicable taxes, which are calculated and collected by Paddle (see Section 5).
We reserve the right to change pricing with 30 days prior notice. Existing subscriptions continue at their current price until the end of the billing period.
4a. Message Limits and Packs
Each plan includes a monthly message allowance. When your usage reaches approximately 90% of your plan's limit, message processing will be paused until the next billing cycle. To continue processing beyond your limit, you may purchase additional message packs. Each message pack adds 10,000 messages to your current billing period and is available for both Pro and Business plans.
Message packs are one-time purchases that apply to the current billing period only. Unused messages from packs do not carry over to the next billing period.
5. Payment, Invoicing, and Merchant of Record
All payments for the Service are processed by Paddle.com Market Limited ("Paddle"), who acts as our merchant of record. Paddle handles billing, invoicing, tax collection, and payment processing on our behalf. When you purchase a subscription or message pack, your contractual payment relationship is with Paddle. Paddle will appear on your bank or credit card statement. Applicable taxes are added at checkout and remitted by Paddle to the relevant authorities. See Paddle's Terms of Use for details.
Alphorn offers a Free plan that you can use indefinitely to evaluate the Service before paying. We do not ask for your credit card to use the Free plan. If you upgrade from the Free plan to a paid plan, you will be charged immediately and your billing cycle starts on the day of the upgrade. Paid plans are charged automatically at the beginning of each billing period. If payment fails, we will notify you and may suspend access to paid features after a 7-day grace period.
The messages included in your paid plan must be used during the applicable billing period. Any unused messages at the end of the period are forfeited and do not carry over. You can upgrade or downgrade your plan at any time from your account settings. Downgrading may cause the loss of features or capacity, and the Provider does not accept any liability for such loss.
Fees paid for the hosted Service are non-refundable. This includes monthly subscription fees and one-time message pack purchases. You can cancel your paid subscription at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then. We do not provide pro-rated refunds for partial months. Nothing in this section limits your mandatory statutory rights as a consumer under Austrian or EU law. 6. Acceptable Use
You agree not to use the Service to:
- Send spam, phishing messages, or unsolicited bulk notifications
- Transmit malware, viruses, or malicious content
- Violate any applicable law or regulation
- Infringe on the rights of third parties
- Attempt to gain unauthorized access to the Service or its infrastructure
- Exceed rate limits or abuse the Service in a way that degrades it for other users
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. Availability and Maintenance
We strive to maintain high availability of the Service but do not guarantee uninterrupted operation. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by circumstances beyond our reasonable control.
8. Data Processing
Notification data (webhook payloads, delivery logs) is processed to provide the Service. Data handling is described in our Privacy Policy. You are responsible for ensuring that the data you send through Alphorn complies with applicable data protection laws.
9. Intellectual Property
The Alphorn software is open source and licensed under the GNU Affero General Public License v3.0 or later (AGPL-3.0-or-later). A separate commercial license is available for organizations that cannot accept AGPL terms. The Alphorn name, logo, and branding are the property of the Provider. Your notification data remains your property.
10. Liability
The Provider is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by Austrian law. The Provider is not liable for indirect damages, lost profits, or damages arising from the unavailability of the Service.
In any case, the Provider's total aggregate liability arising out of or in connection with the Service shall not exceed the total amount paid by the User to the Provider during the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
The Provider is not responsible for the availability or behavior of third-party channel services (e.g. Slack, Discord, Telegram) that you configure as notification destinations.
11. Termination
You may terminate your account at any time through the account settings. Paid subscriptions can be cancelled at any time and will remain active until the end of the current billing period.
We may terminate or suspend your account with 30 days notice, or immediately in case of a material breach of these terms.
12. Changes to These Terms
We may modify these GTC at any time. Material changes will be communicated to registered users via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
13. Governing Law and Jurisdiction
These GTC are governed by Austrian law. For disputes with consumers within the EU, the courts of the consumer's place of residence apply. For all other disputes, the courts of Vienna, Austria have exclusive jurisdiction.
